# Terms of Use
## 1. Introduction
These Terms of Use (“Terms”) govern your access to and use of PumpPoly, including the PumpPoly website, application interface, token launch functionality, trading functionality, decentralized exchange functionality, smart contract and blockchain program interaction tools, reward-related features, social and community features, and other related software services.
PumpPoly is a non-custodial software platform and protocol interface.
The PumpPoly website, application interface, and related software services are developed and operated by **2vers LTD**, a company incorporated in the Republic of Seychelles under the International Business Companies Act, 2016, Company No. **247693**.
References in these Terms to “PumpPoly”, “we”, “us”, or “our” refer to 2vers LTD in its capacity as developer and operator of the PumpPoly website, interface, and related software services, unless the context specifically refers to decentralized smart contracts, blockchain programs, protocols, networks, or third-party infrastructure.
By accessing or using PumpPoly, you agree to these Terms.
If you do not agree with these Terms, you must not use PumpPoly.
## 2. What PumpPoly Is
PumpPoly is a non-custodial, multi-chain software platform and protocol interface designed to provide infrastructure for token creation, token discovery, trading, liquidity, rewards, token graduation, decentralized exchange functionality, and related blockchain interactions.
PumpPoly is designed to support multiple blockchain networks, including **Solana and Base**.
Additional networks, integrations, features, and protocol components may be introduced over time.
Users interact with PumpPoly through blockchain wallets controlled by the users themselves and, where applicable, through blockchain-based smart contracts or programs.
PumpPoly does not take custody of user assets or private keys.
PumpPoly provides software and blockchain infrastructure.
Nothing made available through PumpPoly constitutes or is intended to constitute financial advice, investment advice, trading advice, legal advice, tax advice, asset management, portfolio management, brokerage services, custody services, or a guarantee of any financial outcome.
## 3. Role of 2vers LTD
2vers LTD develops and operates the PumpPoly website, user interface, and related software infrastructure.
2vers LTD does not control user wallets, private keys, seed phrases, recovery phrases, or blockchain accounts controlled by users.
Depending on the relevant network and feature, transactions may be executed by blockchain smart contracts, blockchain programs, validators, decentralized networks, or third-party infrastructure outside the direct control of 2vers LTD.
Operation of the PumpPoly website or interface does not mean that 2vers LTD takes custody, possession, or ownership of digital assets held by users.
Certain blockchain smart contracts or programs may continue to exist or operate independently of the PumpPoly website or interface.
## 4. Non-Custodial Use
PumpPoly is designed to operate on a non-custodial basis.
PumpPoly does not custody user funds.
Transactions are initiated, signed, and authorized through wallets controlled by users.
You are solely responsible for:
* Your wallet;
* Your private keys;
* Your seed or recovery phrases;
* Wallet security;
* Transaction approvals;
* Network selection;
* Transaction parameters;
* Gas or network fees;
* Digital assets held in your wallet; and
* All actions taken through your wallet.
PumpPoly and 2vers LTD will never require your seed phrase, private key, recovery phrase, or wallet password.
If anyone requests this information while claiming to represent PumpPoly or 2vers LTD, you should assume that the request is fraudulent.
Blockchain transactions may be irreversible.
You are responsible for reviewing all transaction details before approving or signing a transaction.
## 5. Eligibility
You may use PumpPoly only if:
* You are at least 18 years old or have reached the legal age of majority in your jurisdiction;
* You have the legal capacity to enter into these Terms;
* Your use of PumpPoly is lawful in your jurisdiction; and
* You are not prohibited from using PumpPoly under applicable laws, regulations, sanctions, court orders, or other legal restrictions.
You must not use PumpPoly if doing so would violate any law, regulation, sanction, restriction, or legal obligation applicable to you.
PumpPoly may restrict, limit, or disable access to the website, interface, or selected features where legal, regulatory, sanctions-related, compliance, security, fraud, or operational risks are identified.
Restrictions applied to the PumpPoly interface do not necessarily prevent users from independently interacting with public blockchain infrastructure through other software.
## 6. Token Launches
PumpPoly may allow users to create tokens through standardized token launch mechanisms.
Creators may be able to provide information including:
* Token name;
* Token ticker;
* Description;
* Images or media;
* Website links;
* Social links; and
* Other supported metadata.
Creators are solely responsible for information, content, representations, branding, communications, marketing materials, and other information they publish in connection with their token.
Creators must not provide fraudulent, misleading, unlawful, infringing, deceptive, or materially inaccurate information.
Under the core PumpPoly launch model, token creation may use standardized parameters intended to reduce hidden or undisclosed token mechanics.
The exact technical parameters applicable to a launch are determined by the active protocol implementation.
Users should review transaction details and applicable token parameters before approving a launch transaction.
Unless expressly stated otherwise, PumpPoly and 2vers LTD do not approve, endorse, recommend, sponsor, guarantee, or independently verify tokens, creators, communities, or projects launched or displayed through PumpPoly.
The appearance of a token on PumpPoly does not constitute an endorsement.
## 7. Trading
Trading digital assets involves significant financial and technical risk.
Token prices may increase or decrease rapidly.
Tokens may lose some or all of their value.
Liquidity may be limited, fragmented, volatile, or disappear entirely.
Markets may be affected by:
* Bots;
* Automated trading;
* Sniping;
* Transaction ordering;
* High volatility;
* Low liquidity;
* Concentrated token ownership;
* Coordinated trading;
* Market manipulation;
* Creator activity;
* Community activity;
* Community abandonment;
* Smart contract vulnerabilities;
* Blockchain congestion;
* Oracle or pricing issues;
* RPC failures;
* Infrastructure failures; or
* Other circumstances outside the control of PumpPoly or 2vers LTD.
You are solely responsible for determining whether any transaction is appropriate for you.
PumpPoly does not guarantee token value, price stability, liquidity, trading volume, creator behavior, community activity, graduation, migration, future demand, profitability, or financial returns.
## 8. Graduation
Tokens launched through PumpPoly may become eligible for graduation when applicable protocol conditions are satisfied.
Graduation may transition a token from its applicable pre-graduation trading mechanism to liquidity and trading infrastructure associated with the PumpPoly DEX.
Graduation criteria, liquidity mechanics, pool creation, migration procedures, settlement rules, and related technical parameters are determined by the active protocol implementation.
PumpPoly does not guarantee that any token will graduate.
PumpPoly does not guarantee that graduation will increase token value, liquidity, trading volume, demand, or market activity.
Blockchain conditions, technical failures, security controls, insufficient liquidity, network congestion, or third-party infrastructure may delay, restrict, or prevent graduation-related operations.
## 9. Pre-Graduation Fees
Eligible pre-graduation trading activity currently uses a total protocol fee of **1.10% of eligible trade value**.
The current pre-graduation allocation is:
* **0.45% — Creator Rewards**
* **0.30% — Trader Rewards**
* **0.27% — PumpPoly**
* **0.08% — DEX Liquidity Reserve**
For illustration only, an eligible trade with a value equivalent to 100 units of the applicable quote asset would generate a total pre-graduation protocol fee equivalent to 1.10 units.
This example excludes separate blockchain network fees, wallet fees, third-party fees, slippage, price impact, and other transaction costs that may apply.
## 10. DEX Liquidity Reserve
A portion of eligible pre-graduation trading activity is allocated to the **DEX Liquidity Reserve**.
The current allocation is **0.08% of eligible pre-graduation trade value**.
The DEX Liquidity Reserve is designed to support PumpPoly liquidity infrastructure, graduation-related liquidity operations, DEX liquidity, and related protocol functions.
The DEX Liquidity Reserve is not a personal reward, deposit, investment account, debt obligation, or amount owed to individual users.
Allocation to the DEX Liquidity Reserve does not create any right to repayment, redemption, ownership, dividends, profit participation, or other financial entitlement.
The precise accounting and deployment mechanics of the reserve are determined by the active protocol implementation.
## 11. Post-Graduation Dynamic DEX Fees
After graduation, eligible trading through the PumpPoly DEX may use dynamic trading fees rather than the fixed pre-graduation fee.
Where the dynamic fee system is active, the current intended fee schedule is:
* **1×G to below 2×G — 1.00%**
* **2×G to below 5×G — 0.90%**
* **5×G to below 10×G — 0.80%**
* **10×G to below 25×G — 0.70%**
* **25×G to below 50×G — 0.60%**
* **50×G to below 100×G — 0.50%**
* **100×G to below 250×G — 0.40%**
* **250×G and above — 0.30%**
For purposes of this schedule, **G** refers to the applicable graduation reference level defined by the active PumpPoly protocol rules for the relevant token.
The protocol may use mechanisms designed to reduce manipulation of dynamic fee tiers, including time-weighted measurements, hysteresis, delayed tier transitions, smoothing mechanisms, or other anti-manipulation controls.
The actual fee applicable to a transaction may depend on the active protocol state at the time of execution.
Where technically feasible, the PumpPoly interface will display the applicable fee before transaction confirmation.
Dynamic fee parameters may be modified where reasonably necessary for security, liquidity sustainability, market integrity, protocol operation, legal compliance, or product development.
## 12. Creator Rewards
Creators may receive rewards derived from eligible trading activity associated with tokens launched through PumpPoly.
During the pre-graduation phase, the current Creator Rewards allocation is **0.45% of eligible trade value**.
Creator Rewards are derived from eligible protocol trading fees.
Creator Rewards are not guaranteed income, guaranteed profit, interest, dividends, wages, or guaranteed financial returns.
Creator Rewards depend on factors including:
* Actual eligible trading activity;
* Protocol rules;
* Reward eligibility;
* Network availability;
* Security controls;
* Technical availability; and
* Applicable anti-abuse rules.
Post-graduation Creator Reward rates or allocations may differ from pre-graduation rates depending on the active PumpPoly DEX fee tier and applicable protocol rules.
## 13. Trader Rewards
PumpPoly may allocate part of eligible protocol trading fees to Trader Rewards.
During the pre-graduation phase, the current Trader Rewards allocation is **0.30% of eligible trade value**.
Trader Rewards may be calculated, accounted for, or distributed according to applicable protocol rules.
These rules may include:
* Eligible trading activity;
* Eligible volume;
* Reward epochs;
* Claim windows;
* Wallet activity;
* Network-specific rules;
* Security controls;
* Anti-abuse controls; and
* Other disclosed eligibility conditions.
Trader Rewards are not guaranteed.
Trading activity undertaken for the purpose of generating rewards may result in losses, fees, slippage, price impact, or other costs exceeding the value of any rewards received.
PumpPoly may reject, invalidate, exclude, limit, delay, or adjust reward eligibility where activity is reasonably determined to involve:
* Duplicate claims;
* Replay attempts;
* Fraudulent claims;
* Manipulation;
* Exploitation;
* Artificial activity;
* Circumvention of protocol rules;
* Accounting abuse; or
* Other prohibited conduct.
Post-graduation Trader Reward rates or allocations may differ depending on the active PumpPoly DEX fee tier and applicable protocol rules.
## 14. Reward Claims and Accounting
Where rewards require a claim transaction, users are responsible for submitting and authorizing the applicable blockchain transaction through their wallet.
Rewards may be subject to:
* Eligibility requirements;
* Claim windows;
* Minimum thresholds;
* Network fees;
* Security validation;
* Reward epochs;
* Settlement;
* Protocol accounting rules; and
* Other disclosed technical conditions.
A reward displayed as estimated, pending, projected, accrued, or otherwise visible in the PumpPoly interface does not necessarily mean that the reward is immediately claimable.
The PumpPoly interface may display information derived from blockchain data, indexing infrastructure, caches, or other data-processing systems.
Where there is a discrepancy between an informational frontend display and the authoritative protocol or blockchain state, the applicable verified protocol state and canonical accounting rules will control to the extent technically and legally applicable.
## 15. Automation and Bots
PumpPoly is intended to support legitimate blockchain activity, including certain automated interactions where permitted by applicable protocol rules.
The use of bots, scripts, APIs, automated trading systems, or other automation is not prohibited solely because the activity is automated.
However, users must not use automation to:
* Exploit vulnerabilities;
* Circumvent protocol rules;
* Manipulate rewards;
* Generate fraudulent claims;
* Create deceptive or artificial activity;
* Conduct prohibited market manipulation;
* Interfere with other users;
* Overload infrastructure;
* Bypass security controls;
* Abuse reward accounting; or
* Otherwise violate these Terms or applicable law.
PumpPoly may implement technical, security, or economic controls designed to prevent abusive or manipulative automation.
## 16. Future Ecosystem Features and Tokens
PumpPoly may introduce additional ecosystem features in the future.
These may include:
* Social functionality;
* Community functionality;
* Reputation systems;
* Creator profiles;
* Trader profiles;
* Notifications;
* Watchlists;
* Governance-related functionality;
* Access-related functionality;
* Ecosystem incentives; or
* A separate ecosystem token.
Unless expressly provided otherwise in separate official documentation, any future PumpPoly ecosystem token:
* Is not required to launch tokens on PumpPoly;
* Is not required to trade through PumpPoly;
* Does not represent ownership of 2vers LTD;
* Does not automatically represent ownership of PumpPoly;
* Does not automatically provide dividends;
* Does not automatically provide revenue rights;
* Does not guarantee profit;
* Does not guarantee appreciation;
* Does not create a guaranteed redemption right; and
* Does not create any guaranteed financial return.
Any future tokenomics, distribution mechanics, functionality, utility, eligibility rules, or related terms will be described separately if and when such functionality is introduced.
## 17. Social and Community Features
PumpPoly may provide social, profile, reputation, community, content, activity-feed, notification, watchlist, messaging, or creator-related features.
Users are responsible for content they submit or publish.
Users must not publish content that is:
* Illegal;
* Fraudulent;
* Misleading;
* Deceptive;
* Threatening;
* Abusive;
* Malicious;
* Infringing; or
* Designed to facilitate scams or other unlawful activity.
Where you submit content through PumpPoly, you grant 2vers LTD a non-exclusive, worldwide, royalty-free license to host, reproduce, display, process, and distribute that content solely to the extent reasonably necessary to operate, secure, moderate, improve, or provide the relevant PumpPoly services.
You retain ownership of your content subject to rights granted under these Terms.
PumpPoly may remove, restrict, hide, or moderate content where reasonably necessary for security, legal compliance, platform integrity, or enforcement of these Terms.
Social activity, reputation indicators, rankings, trading activity, statistics, follower counts, or community content should not be interpreted as investment advice or endorsement.
## 18. Smart Contract and Blockchain Risk
PumpPoly may interact with smart contracts, blockchain programs, decentralized networks, liquidity pools, and other blockchain infrastructure.
Smart contracts and blockchain programs may contain:
* Bugs;
* Vulnerabilities;
* Unexpected behavior;
* Configuration errors;
* Economic design risks; or
* Security weaknesses.
Blockchain networks may experience:
* Congestion;
* Reorganizations;
* Downtime;
* Validator failures;
* RPC failures;
* Transaction failures;
* Increased fees;
* Forks;
* Protocol upgrades; or
* Other technical disruptions.
Transactions may fail or execute differently from expectations because of slippage, transaction ordering, network conditions, wallet behavior, or other technical circumstances.
PumpPoly and 2vers LTD do not guarantee uninterrupted access, error-free execution, transaction finality, liquidity availability, or recovery of lost digital assets.
## 19. Third-Party Services
PumpPoly may integrate with or rely on third-party technologies or services, including:
* Wallet providers;
* Blockchain networks;
* RPC providers;
* Blockchain explorers;
* Analytics providers;
* Data providers;
* Hosting providers;
* Security providers;
* Social platforms;
* Liquidity infrastructure;
* Token metadata services; and
* Other third-party providers.
2vers LTD does not control all third-party services.
PumpPoly and 2vers LTD are not responsible for the availability, accuracy, security, functionality, fees, privacy practices, terms, failures, or actions of independent third-party services.
Your use of third-party services may be subject to separate terms and privacy policies.
## 20. Prohibited Use
You must not use PumpPoly to:
* Violate applicable laws or regulations;
* Commit or facilitate fraud;
* Conduct phishing or impersonation;
* Facilitate money laundering;
* Evade applicable sanctions;
* Manipulate protocol rewards;
* Submit fraudulent reward claims;
* Exploit vulnerabilities;
* Interfere with PumpPoly infrastructure;
* Introduce malicious software;
* Gain unauthorized access to systems or accounts;
* Misrepresent PumpPoly or 2vers LTD;
* Publish intentionally deceptive official links or contract addresses;
* Infringe intellectual property rights;
* Abuse or threaten other users;
* Conduct prohibited market manipulation; or
* Circumvent security or access controls.
PumpPoly may restrict, block, suspend, or limit access to the PumpPoly interface where reasonably necessary to address prohibited activity, fraud, abuse, security risks, sanctions requirements, or other legal obligations.
## 21. Intellectual Property
The PumpPoly name, website, interface, branding, documentation, visual materials, and software components made available by 2vers LTD may be protected by copyright, trademark, database rights, or other intellectual property rights.
Such rights may belong to 2vers LTD or applicable licensors.
Nothing in these Terms transfers ownership of PumpPoly intellectual property to users.
Open-source software remains subject to its applicable open-source licenses.
Third-party trademarks, names, logos, and content remain the property of their respective owners.
## 22. No Financial or Investment Advice
Information displayed through PumpPoly, including:
* Token information;
* Charts;
* Prices;
* Market data;
* Trading activity;
* Rankings;
* Trending information;
* Creator information;
* Rewards;
* Graduation progress;
* Social activity;
* Community content; and
* Other statistics
is provided for informational, technical, or functional purposes only.
Nothing on PumpPoly constitutes a recommendation to buy, sell, hold, create, launch, or otherwise interact with any digital asset.
PumpPoly and 2vers LTD do not provide financial, investment, legal, tax, or trading advice.
Users are responsible for their own decisions and should seek independent professional advice where appropriate.
## 23. No Warranties
PumpPoly is provided on an **“as is”** and **“as available”** basis.
To the maximum extent permitted by applicable law, 2vers LTD makes no representation or warranty regarding:
* Availability;
* Reliability;
* Security;
* Accuracy;
* Completeness;
* Performance;
* Uninterrupted operation;
* Smart contract functionality;
* Reward availability;
* Liquidity;
* Token value;
* Market behavior;
* Transaction execution;
* Third-party services; or
* Fitness for a particular purpose.
No information provided through PumpPoly creates a warranty unless expressly required by applicable law.
## 24. Limitation of Liability
To the maximum extent permitted by applicable law, 2vers LTD and its directors, officers, employees, contractors, affiliates, contributors, developers, and service providers will not be liable for losses arising from or relating to your use of PumpPoly.
This may include losses arising from:
* Trading losses;
* Loss of digital assets;
* Loss of profits;
* Price movements;
* Failed transactions;
* Wallet compromise;
* User error;
* Smart contract failures;
* Blockchain failures;
* Network congestion;
* Liquidity shortages;
* Token creator misconduct;
* Third-party fraud;
* Phishing;
* Third-party service failures;
* Incorrect or delayed information;
* Unauthorized wallet access;
* Security incidents; or
* Inability to access the PumpPoly interface.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
You acknowledge that blockchain and digital asset activity involves substantial financial and technical risk.
## 25. Taxes
You are solely responsible for determining and satisfying any tax, reporting, filing, withholding, accounting, or other obligations arising from your use of PumpPoly.
This includes obligations relating to:
* Token launches;
* Token trading;
* Creator Rewards;
* Trader Rewards;
* Digital asset gains or losses;
* Transfers; and
* Other blockchain activity.
PumpPoly and 2vers LTD do not provide tax advice.
## 26. Privacy
Use of the PumpPoly website and related software services may involve the processing of certain information.
Information concerning the collection, use, processing, and protection of information is described in the **PumpPoly Privacy Policy**.
Blockchain transactions are generally public and may be permanently recorded on decentralized networks.
Information written to public blockchains may not be capable of being modified or deleted by PumpPoly or 2vers LTD.
## 27. Changes to PumpPoly
PumpPoly may update, modify, add, remove, suspend, restrict, or discontinue features of the PumpPoly interface or related software services.
This may include changes to:
* Supported blockchain networks;
* Launch mechanics;
* Trading functionality;
* Graduation mechanics;
* Liquidity systems;
* Fee parameters;
* Reward rules;
* Dynamic fee systems;
* Social functionality;
* Security controls;
* Access rules; and
* Interface functionality.
Changes may be made for security, technical, operational, regulatory, legal, market, or product-development reasons.
Where reasonably appropriate, material changes may be communicated through official PumpPoly channels.
## 28. Changes to These Terms
These Terms may be updated from time to time.
The current version will be published on the official PumpPoly website together with an updated “Last updated” date.
Where required by applicable law, additional notice may be provided for material changes.
Your continued use of PumpPoly after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
If you do not agree with updated Terms, you must stop using the PumpPoly interface and related services.
## 29. Suspension and Termination
PumpPoly may suspend, restrict, or terminate access to the PumpPoly website or interface where reasonably necessary for:
* Security;
* Fraud prevention;
* Abuse prevention;
* Legal compliance;
* Sanctions compliance;
* Infrastructure protection;
* Enforcement of these Terms; or
* Protection of users or third parties.
Because certain blockchain programs or smart contracts may operate independently, restricting access to the PumpPoly interface does not necessarily prevent interaction with public blockchain infrastructure through third-party software.
## 30. Governing Law and Jurisdiction
These Terms are governed by the laws of the **Republic of Seychelles**, without regard to conflict-of-law principles, except where mandatory applicable law provides otherwise.
Subject to any mandatory rights or jurisdictional protections available under applicable law, disputes arising out of or relating to these Terms, the PumpPoly website, interface, or related software services shall be subject to the jurisdiction of the competent courts of the Republic of Seychelles.
Nothing in this section limits any rights that cannot lawfully be excluded or restricted under applicable law.
## 31. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the maximum extent permitted by law.
Where legally permissible, an invalid or unenforceable provision should be interpreted or modified in a manner that most closely reflects its original purpose while remaining enforceable.
## 32. No Waiver
Failure by 2vers LTD to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
## 33. Entire Agreement
These Terms, together with the PumpPoly Privacy Policy and any additional terms expressly applicable to specific PumpPoly services, constitute the agreement governing your use of the PumpPoly website, interface, and related software services.
